Appendix Domain Blocking

This Appendix regulates the use of AdultBlock or the AdultBlock+ Service which is provided by ICM Registry.

§1 Service

ICM Registry developed a Service that allows You to block a domain name which contains a trademark to which You are the legitimate rights holder under any of the TLDs offered by the Registry to prevent registrations by third parties.

Please note that the service can only be used for new registrations and has no effect on registrations that have already been made. If a domain name has already been registered but expires or will be deleted the AdultBlock Service will be available again for these domain names.

Please note that there is no Grace period (AdultBlock Grace Period) being offered.

§2 Eligibility

To be eligible to use the Service in §1 you need to be the legitimate rights holder of a Trademark. You can proof you eligibility with the following:

• a Signed Mark Data file, pursuant to ICANN established policies and procedures (“SMD”) that is generated through the Trademark Clearinghouse (http://www.trademark-clearinghouse.com (“TMCH”)
• Your, or Your authorized agent’s, participation in the 2011 .XXX Sunrise B program
• Your, or Your authorized agent’s, provision of required verification data regarding either a registered or unregistered trademark that did not participate in the 2011 .XXX Sunrise B Program and/or does not have an SMD file (“New Trademark”).

§3 Third Party Terms

ICM Registry is a third party company providing the above mentioned service. We ask that you acknowledge and agree that you have to comply with the Terms and Conditions of ICM Registry regarding AdultBlock or the AdultBlock+ Service.

§4 Liability

Our company does not in any way give any guarantees as to the availability of the described service. The service is provided as-is. Furthermore we can not take any liability arising from the availability and use of the service.

§5 Term

This appendix is valid for an undetermined time period and tied to the duration of the RSP agreement. Separate ordinary termination of this appendix is possible at any time, but must be confirmed by both parties. An unilateral termination notice for important cause can be given at any time.

§6 Severability

Should a regulation of this appendix to the RSP agreement be invalid at law or become invalid at law, then the validity of the other regulations will not be affected. This appendix may be modified or amended if the amendment is made in writing and is signed by both parties. This agreement shall be governed by the laws of Germany. Legal domicile is Saarbrücken.
