.XXX - IMPORTANT UPDATE

Are you ready for the upcoming release of .XXX domains? Do you and your customers who hold brand names know that there is a cost effective way to secure their branded .XXX domain without additional fees every year (called Sunrise B). Read more about .XXX below and get ready for one of the hottest new TLDs arriving soon.

In the event you do not wish to register your .XXX Trademark domain during Sunrise A or Sunrise A_Grandfathering, an excellent alternative is to register it during Sunrise B in order to avoid any abuse of your Trademark, once the registry is opened to the public. There will NOT be any ongoing costs once the domain was successfully registered during Sunrise B, as it is solely a ONE-TIME FEE.

If the Trademark during Sunrise B is validated successfully, a block will be applied to the string, however without any ownership or annual registration fee.  A successful application to block a domain name by a single qualified applicant under Sunrise B and not subject to a competing application from a sponsored community applicant under Sunrise A, will be designated “reserved – trademark” or similar.  It will be removed from the pool of names available for registration in future phases of the registry operation and the WHOIS information will simply list standard registry information. The corresponding domain name will resolve to a standard informational page indicating the status of the domain name as not available for registration or similar. Allowing the domain name to resolve is designed to prevent “synthetic DNS” or non-DNS resolution systems, from hi-jacking queries to these domain names.  Note: In the event that there is more than one qualified applicant under Sunrise B , the name will be reserved in exactly the same way as if there were only a single applicant and there will be no refund or apportionment of fees amongst such applicants.  A domain name applied for by a single qualified applicant under Sunrise A, and not subject to a competing application from an applicant under Sunrise B, will be allocated to the applicant.

Sunrise A. & Landrush Authentication Process:

During Sunrise A and Landrush, members of the Sponsored Community are required to authenticate before they are awarded the domain or proceed to auction. The deadline will be up to 48 hours after the close of Sunrise/Landrush. If the Applicant does not authenticate via our membership validation process by the deadline, they will lose their application and no refund will be provided.

The authentication process during Sunrise A/Landrush will be:

  1. The Registrant registers domain(s) with HEXONET and attests he/she is a member of the Sponsored Community.
  2. We submit paid application(s) to the Registry.
  3. ICM Registry emails the Registrant a link to authenticate on our website within 24 hours of submission.
  4. The Registrant completes the authentication process from the link provided.

Defensive Registrations During General Availability:

Non-members of the Sponsored Community will have the opportunity to register domain names defensively.  All you have to do is simply register the domain and NOT authenticate on the registry website.  As such the domain will NOT resolve.  This means, that you can basically register as many domain as you like without having them resolve or authenticated.

Q. Who can register a .XXX Domain?

Individuals, business, entities, and organizations that provide online, sexually-oriented adult entertainment (“Online Adult Entertainment”) intended for consenting adults or for other community members (“Providers”); Represent Providers (“Representatives”); or Provide products or services to Providers and Representatives (“Service Providers”) are eligible to register .XXX domain names.

Q. Why should I block my names?  I am not in the adult industry?

As with any current domain name registry, once the landrush and general availability phases are running, the registry will be run on a first come first served basis and with no pre-emptive rights protection in place. Although there will be post launch rights protection mechanisms in place, we believe that many rights owners will take a prevention is better than cure approach.

Q. When it comes to sunrise, does the trademark need to be an exact match or can it be a substantial match?

An exact match is required with reasonable rules for special character transcription.

Q. How will the registry validate that the registrant is in the sponsored community?

Each and every registrant will need to be verified and signed up to the sponsored community before the domain name will be permitted to resolve and therefore operate. Those who don’t validate will be unable to resolve their domains in the usual way.
